Open Waters Design and Manufacturing 5-Year Warranty & Performance Guarantee

Workmanship Warranty – 5 Years
Open Waters Design and Manufacturing, doing business as Open Waters Solar, warrants that its solar panels are free from defects in materials and workmanship for a period of five (5) years from the date of purchase. Each panel is individually tested to ensure compliance with our stringent quality standards. In the event that a defect in workmanship is discovered, the Buyer shall return the panel to us for inspection. Upon confirmation of the defect, we reserve the sole right to determine whether to repair, replace, or refund the defective panel. Open Waters Solar is committed to ensuring that its products meet or exceed performance expectations and will not fail due to inherent manufacturing flaws.

Performance Guarantee – 5 Years
We provide a performance guarantee that, for a period of five (5) years from the date of purchase, each solar panel will maintain at least eighty percent (80%) of its rated power output under Standard Test Conditions (STC). It should be noted that dropping to or below 80% efficiency within this timeframe is highly unusual, as our panels are engineered to maintain a high level of efficiency far beyond the five-year period. In the rare instance that a panel's power output falls below 80%, Open Waters Solar will, at its discretion, either issue a refund proportional to the power loss or replace the underperforming panel with a panel of comparable output from our current product line. We strive to accommodate unique situations on a case-by-case basis, ensuring that customers are provided with fair remedies. 

Exclusions
This warranty expressly excludes coverage for damage arising from the following circumstances:

  • Acts of God, including but not limited to hurricanes, floods, lightning, and other natural disasters.
  • Misuse, abuse, or improper installation, including but not limited to placement of the panel in high-risk areas where it may be subject to physical impacts, such as on the bow of a vessel where it may collide with docks or other watercraft.
  • Installation of panels below the waterline or in locations not suitable for photovoltaic systems.
  • Persistent and intentional damage beyond normal wear and tear, including neglect or failure to properly maintain the panels as outlined in our care instructions.

Resolution of Warranty Claims
Before pursuing any legal remedies, Open Waters Solar is dedicated to resolving disputes through mutual cooperation. In the case of partial power failure or malfunction affecting only certain cells, we will work with the Buyer to repair or restore functionality. For larger systemic issues, we will evaluate the circumstances and, if necessary, issue a refund, provide a replacement, or offer an alternative solution. Should a dispute arise that cannot be settled amicably, arbitration shall be required prior to the pursuit of legal action.

Improper Uses of Solar Panels
To prolong the longevity and maintain the performance of your solar panels, avoid improper uses, such as installing them in areas prone to constant collisions (e.g., on the bow of your boat where the panels may be struck by docks or other vessels). Do not install the panels below the waterline, as they are not designed for submersion. Panels should not be mounted on unreinforced structures that could fail under the panel's weight or environmental stress. While our panels are built to withstand impact and are extremely durable, they are not indestructible. Respect their design limitations to ensure long-term functionality.

By purchasing any product from Open Waters Design and Manufacturing, doing business as Open Waters Solar, the Buyer acknowledges and agrees to the terms and conditions set forth in this warranty agreement. Such purchase constitutes the Buyer's acceptance of these warranty provisions, including all exclusions, limitations, and obligations herein. The Buyer further agrees that this warranty forms an integral part of the purchase contract and is binding upon both parties, superseding any conflicting representations or understandings, whether oral or written, not explicitly included within this document.
